These terms are the agreement between you and Land Supply, Inc., a Delaware corporation ("Land Supply," "Overshot," "we," "us" or "our"), for the Overshot app, its memberships and related services. Overshot is a product and brand of Land Supply, Inc. Our Privacy Policy says what we do with your information.
PLEASE READ THESE TERMS CAREFULLY. THEY CONTAIN A SAFETY DISCLAIMER, AN ASSUMPTION OF RISK, LIMITS ON OUR LIABILITY, AND A BINDING INDIVIDUAL ARBITRATION AGREEMENT WITH A CLASS ACTION AND JURY TRIAL WAIVER (SEE "ARBITRATION AND CLASS ACTION WAIVER" BELOW). YOU MAY OPT OUT OF ARBITRATION WITHIN 30 DAYS. BY CREATING AN ACCOUNT OR USING OVERSHOT YOU AGREE TO THESE TERMS. IF YOU DO NOT AGREE, DO NOT USE OVERSHOT.
Reference only. Overshot is not a guarantee of safety. Everything in Overshot is general reference information, provided for reference purposes only. This includes alerts, forecasts, hazard records, climate readings, your plan, preparations, Ask answers, check-ins, guides and product suggestions. None of it is advice, an assessment of your circumstances, or a determination that any action, place, route, product or condition is safe for you.
Your responsibility. You alone are responsible for your safety, for your decisions, and for the safety of everyone in your care. You decide whether information is suitable for your location, home, household, health, abilities, equipment and current conditions. You use Overshot, and you act or do not act on anything in it, at your own risk. You voluntarily assume all risks of injury, illness, death, property damage and other loss that arise from your use of, reliance on, or inability to use Overshot.
Official guidance and your own judgment come first. Always follow current directions, warnings, evacuation orders, closures and public-health instructions from the authorities responsible for your location, and use your own judgment. They take priority over anything in Overshot. Do not wait for Overshot, an alert, an update or a reply from us before you leave, shelter, seek medical care or take any other urgent step.
Overshot is not an emergency service. In an emergency, call 911. Overshot is not a live warning system, a dispatch service, or a continuously monitored safety channel.
No duty to monitor or warn. We do not undertake to monitor you, your places, your household or conditions, and we have no duty to warn you of any hazard. A missing, late, incomplete or wrong alert, a completed plan, a full list of preparations, or a quiet screen is not evidence that conditions are safe. Alerts depend on your phone, your settings, your network, notification services and public data sources, and may not arrive or may arrive late.
Circle check-ins are not monitoring or rescue. A check-in, a "needs help" report, or a request to someone in your Circle is a message between people. It is not monitoring, dispatch or rescue. Nobody at Overshot watches check-ins or responds to them. A "needs help" report does not summon help. Call 911.
Ask is written by AI and may be wrong. Ask answers are produced by an artificial intelligence model. They can be incomplete, out of date or incorrect. Check anything that matters against the official source.
Products are sold by third parties. Kits and products shown or suggested in Overshot are sold by third parties. Overshot does not make, inspect or warrant them, and a suggestion is not a promise that a product is suitable, safe or in stock.
No liability for safety outcomes. To the fullest extent the law allows, Land Supply, Inc. and its officers, directors, employees, contractors and agents are not liable for injury, illness, death, property damage or any other loss arising from your use of, reliance on, or inability to use Overshot, including any hazard, emergency or disaster, and any decision you or anyone else makes. These terms do not exclude or limit any liability or right that applicable law does not allow to be excluded or limited, including nonwaivable consumer rights and liability for fraud, gross negligence, willful misconduct, or death or personal injury that cannot lawfully be excluded.
Overshot gives you information and planning tools: hazards and conditions for your places, a plan for your household, a Vault for your papers, a Circle of people to check on, and Ask, which answers questions about your place. It draws on public data and on what you tell it. A county record can differ from conditions at your address.
Overshot is not medical, veterinary, legal, insurance, financial, engineering, electrical or other professional advice, and it creates no professional relationship with you. Ask a qualified professional for decisions that need an individual assessment, such as medication and medical equipment, building or electrical work, water testing, structural safety, insurance coverage and your legal rights. Do not change prescribed treatment, ignore professional advice or delay getting it because of something in Overshot. Follow local codes, product labels, recalls and manufacturer instructions. Do not attempt work that is unsafe, unlawful or beyond your training.
We aim to provide useful, source-backed information. We do not warrant that it is complete, accurate, current or suitable for every situation. Forecasts, projections, maps, estimates and risk ratings involve uncertainty, and conditions can change faster than Overshot can update. A source date describes an editorial review, not continuous verification. A citation is not an endorsement of Overshot by the source. Check the original source and current local guidance before you act. Saved, downloaded or offline copies can become out of date.
Overshot links to outside sources and may mention third-party products or services, including the maps, weather services, stores and AI providers it relies on. We do not control their content, availability, safety, performance or privacy practices, and a link or mention does not guarantee that a product or service is right for you or that an insurer, provider or authority will approve an action or claim. Evaluate them yourself and read their terms.
You must be at least 13 years old. Give accurate information and keep your sign-in details to yourself. You are responsible for what happens under your account. Tell us if you think someone else has used it. You can use some of Overshot before you sign up. Sign up to keep your data if you change phones.
You can invite people to your household and add people to your Circle. Only add someone if you have their permission to share their name and contact details with Overshot. A household member can see what you share with the household, and people in your Circle can see your check-ins. Tell the people you add what Overshot will do with their details. Invitations are sent when you send them. We do not contact people on your behalf in other ways.
Information you add, such as places, answers, notes, contacts and Vault documents, stays yours. You give Overshot permission to store, process and display it to provide the service to you and the people you choose to share it with. Do not add anything you do not have the right to share. Do not use free notes for passwords or security codes. Use the Vault's secret fields. You are responsible for keeping your own copies of important papers.
Overshot offers paid memberships: one person, or a household of up to six. Prices and plans are shown in the app before you buy.

cancel. It renews unless you cancel at least 24 hours before the current period ends, and that includes a trial.
your Overshot account does not cancel it.

Do not use Overshot to harass, follow or contact someone who has asked not to be contacted. Do not try to get into another person's account or data, or upload files that are illegal or that you have no right to upload. Do not copy Overshot's data in bulk, interfere with it, or get around its limits. Do not reverse engineer the app, except where the law allows. We may suspend or end access if you break these rules or put others at risk.
TO THE FULLEST EXTENT THE LAW ALLOWS, OVERSHOT AND ALL ITS CONTENT ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF ACCURACY, RELIABILITY, TIMELINESS, MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NONINFRINGEMENT. WE DO NOT PROMISE UNINTERRUPTED, ERROR-FREE OR SECURE ACCESS, OR THAT ANY ALERT OR NOTIFICATION WILL BE SENT OR RECEIVED.
Power, internet, your phone, third-party services or Overshot itself may fail exactly when you need information. Keep essential plans, contact numbers and official sources available by other means. We may change, suspend or end any part of Overshot.
TO THE FULLEST EXTENT THE LAW ALLOWS, LAND SUPPLY, INC. AND ITS OFFICERS, DIRECTORS, EMPLOYEES, CONTRACTORS AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY OR PUNITIVE DAMAGES, OR FOR LOSS OF DATA, PROPERTY, INCOME OR PROFIT, ARISING FROM OR RELATED TO OVERSHOT OR THESE TERMS, EVEN IF ADVISED OF THE POSSIBILITY. TO THE FULLEST EXTENT THE LAW ALLOWS, OUR TOTAL LIABILITY FOR ALL CLAIMS RELATED TO OVERSHOT IS LIMITED TO THE GREATER OF THE AMOUNT YOU PAID US IN THE TWELVE MONTHS BEFORE THE CLAIM OR 100 US DOLLARS. Some places do not allow some of these limits, so they may not apply to you, and nothing in these terms limits liability that the law does not allow to be limited. Your responsibility for your own decisions does not remove responsibilities the law places on us.
To the extent the law allows, you release Land Supply, Inc. and its officers, directors, employees, contractors and agents from claims, demands and damages, known or unknown, arising from your use of, reliance on, or inability to use Overshot, including claims for injury, illness, death or property damage from a hazard, emergency or disaster. If you live in California, you waive California Civil Code section 1542, which says: "A general release does not extend to claims that the creditor or releasing party does not know or suspect to exist in his or her favor at the time of executing the release and that, if known by him or her, would have materially affected his or her settlement with the debtor or released party." You also waive any similar law of another place. This release does not apply to anything the law does not allow you to release.
To the extent the law allows, you will defend and indemnify Land Supply, Inc. and its officers, directors, employees, contractors and agents against claims, losses, damages and costs (including reasonable attorneys' fees) arising from your use of Overshot, your content, your breach of these terms, your violation of any law or anyone's rights, or a claim by a person in your household, Circle or care about something you did or did not do based on Overshot.
Overshot is also available inside ChatGPT and Claude. These terms apply to that connector along with the rest of this page.
What it gives. General information about a US place, read from public data: hazards and their history, active National Weather Service alerts, the season, preparations, power outages and air quality. Each answer names its sources.
Emergencies. Overshot is not an emergency service. In an active emergency, follow guidance from the National Weather Service, local authorities or 911.
Professional advice. Overshot gives general information. For medical, legal, financial, insurance or building decisions, ask a licensed professional.
Accuracy. Answers reflect the sources at the time Overshot read them. Alerts can change after they are read, and a county record can differ from conditions at a single address. Check the issuing agency for the current state of an alert.
Use. The connector is free to use. Do not use it to copy the record in bulk, to overload it, or to get around its limits. Overshot may slow, refuse or end requests that do, and may change or end the connector at any time.
The assistant. ChatGPT and Claude write the words around Overshot's answers. Your use of them is under their own terms.
Age. You must be at least 13 years old to use the connector.
PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS.
Agreement to arbitrate. You and Land Supply, Inc. agree that any dispute, claim or controversy between us arising from or relating to these terms or Overshot, including its existence, scope or enforceability, will be resolved by final and binding arbitration on an individual basis, and not in court before a judge or jury. This includes claims that arose before you accepted these terms.
Exceptions. Either of us may bring an individual claim in small claims court if it qualifies. Either of us may ask a court for an injunction to stop the infringement or misuse of intellectual property. Claims that the law does not allow to be arbitrated are not covered.
Rules. The American Arbitration Association (AAA) will run the arbitration under its Consumer Arbitration Rules, which are at adr.org. The AAA's consumer fee schedule applies, and we will pay the filing, administrative and arbitrator fees that it requires us to pay. Unless you and we agree otherwise, a hearing will be held by video or phone, or in the county where you live. The arbitrator must apply the law and these terms, and may award the same individual relief a court could. The Federal Arbitration Act governs this section.
No class actions and no jury. Each of us may bring claims only on an individual basis, and not as a plaintiff or member of a class, collective, consolidated or representative action. The arbitrator may not combine more than one person's claims. YOU AND LAND SUPPLY, INC. EACH WAIVE THE RIGHT TO A JURY TRIAL AND THE RIGHT TO PARTICIPATE IN A CLASS ACTION. If this waiver is found unenforceable for a claim, that claim goes to court and not to arbitration, and the rest of this section still applies.
Before you file. Each of us will first try to settle a dispute informally. Write to hello@joinovershot.com with your name, your account email and what you want, and give us 30 days to respond before you start an arbitration.
30-day opt out. You can opt out of this arbitration agreement by emailing hello@joinovershot.com within 30 days of first accepting these terms, with "Arbitration opt-out," your name and your account email. If you opt out, the rest of these terms still apply and disputes go to the courts named below.
The laws of the State of Delaware and applicable US federal law govern these terms and any dispute, without regard to conflict of law rules. Subject to the arbitration section, you and Land Supply, Inc. submit to the courts located in Delaware, unless the law where you live gives you the right to bring a claim somewhere else.
You can delete your account in the app. We can end or limit an account that breaks these terms. Sections that by their nature continue, such as the safety disclaimer, the release, the limits on liability and the arbitration agreement, continue after an account ends.
These terms are between you and Land Supply, Inc., and not with Apple. Apple has no duty to provide support or maintenance for Overshot, and is not responsible for claims about it, such as product liability, legal compliance or intellectual property. If Overshot fails to meet a warranty, you may tell Apple, and Apple may refund the purchase price of the app. Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you. You confirm you are not in a country under a US embargo and not on a US list of prohibited parties. If a third party's terms apply when you use Overshot, such as your phone carrier's, you must follow them.
We may update these terms as Overshot changes. We will post the new terms with an updated date. If a change is material, we will tell you in the app or by email before it takes effect, and ask you to agree where the law requires. If you keep using Overshot after that, you accept the new terms. If you do not agree, delete your account. Changes do not remove rights you already have. If a provision is unenforceable, the rest continue to apply to the extent the law allows.
